**Terms and Conditions of Service for FTBLPROFILER**

Thank you for choosing FTBLPROFILER ("we," "us," or "our''). By using our services, you agree to comply with and be bound by the following Terms and Conditions of Service. Please read these terms carefully before using our website or services.

You (the paying “user” or “member” of the site) guarantee that you are the player, or the player’s parent or legal guardian, and you are engaging in these services in the best interests of the player. Your payment signifies your acceptance of these Terms and Conditions of Service.

**1. Service Description:**

1.1 **Soccer CV & Highlight Tape Creation, Phone Advisory Calls, Membership Services**

- FTBLPROFILER provides services to create professional soccer curriculum vitae (CVs) based on the information provided by the user within 4 weeks of the purchase date.

- FTBLPROFILER provides services to create a professional highlight video based on video material provided by the user within 4 weeks of the purchase date.

- FTBLPROFILER provides consultation and advisory services to players based on the information provided by the user.

- For the phone advisory call service, both as an independent service and a part of the member package, will be set up for a 15-minute conversation between the user and the FTBLPROFILER partner(s) at a mutually agreeable time within two weeks of buying the service. FTBLPROFILER will offer the user a minimum of 3 time slots within those 2 weeks to set up a time that works for the call.

- FTBLPROFILER provides membership services which include; access to training plans upon request, phone/video calls upon request, access to founding members personal contact information, access to collegiate mens/womens coaches’ contact information, access to agency contact pages upon request.

1.2 **User Responsibility:**

- Users are responsible for providing accurate and up-to-date information for the CV creation process, highlight tape creation process, video advisory calls and/or when accessing any other membership services.

- Users are responsible for ensuring that they are providing the player’s own materials, with full permission to use any photographs or video of matches and the player.

**2. Payment and Fees:**

2.1 **Payment Authorization:**

- By using our services, you authorize FTBLPROFILER to charge the applicable fees to the payment method provided.

Payment methods accepted must be compatible with the Stripe payment system. Apple Pay is also accepted.

2.2 **Refunds:**

- NO refund policy on packages purchased. If you are dissatisfied with the product please let us know what is missing within one week via email and we will redeliver one updated package with any new information you have submitted to us within two weeks.

**3. Intellectual Property:**

3.1 **CV/Highlight Tape, Membership Services Ownership:**

- The completed soccer CV/Highlight tape is owned by the user, and FTBLPROFILER retains no rights to withhold it from the user at any given time.

- The CV/Highlight tape rights are also allowed for FTBLPROFILER to use or reproduce it for any purpose regarding promoting the service.

- FTBLPROFILER has rights to the information provided in the membership services; the user is not to share the information of protected member site assets with non-members. If shared to a non-member the user will be subject to copyright laws.

3.2 **Brand Copyrights.**

- FTBLPROFILER owns the exclusive rights to the name.

- FTBLPROFILER owns the exclusive rights to any services on the website and we can edit these at our sole discretion.

**4. User Conduct:**

4.1 **Accuracy of Information:**

- Users must provide accurate, truthful and current information for the CV creation process and for us to be able to advise and consult to the best of our ability.

- It must be the personal information of the user or from the parent/rightful guardian of the player providing the personal and professional information of the player to this site for the provisions of the services.

4.2 **Prohibited Content:**

- Users must not submit content that is unlawful, offensive, or violates any third-party rights.

- Users must not make inappropriate, defamatory or discriminatory comments on the site, or comments with copyright infringements. User comments are the sole responsibility of the user and liability only accrues to the user for any public comment. These will be removed at the sole discretion of FTBLPROFILER as soon as they are brought to the attention of FTBLPROFILER.

**5. Limitation of Liability:**

5.1 **No Guarantee:**

- FTBLPROFILER does not guarantee the success of the player.

- FTBLPROFILER does not guarantee the success of your soccer CV, our advice, or our training plans and membership services in any specific context, such as job applications or player scouting.

5.2 **Indemnification:**

- Users agree to indemnify and hold FTBLPROFILER harmless from any claims arising out of the use of our services.

- We are not a professional agency and will not be held responsible for users' career decisions or life choices. We simply offer information and our perspective on users' situations.

- We are not responsible for injuries sustained when executing exercises in our training plan or videos. Users agree that they are responsible for making their own choices about how to engage in any activities.

**6. Termination & Rights of Refusal**

6.1 **Termination by User:**

- Users may terminate their use of our services or their membership at any time.

- User reserves the right to terminate a phone or video call at any time.

6.2 **Termination by FTBLPROFILER:**

- FTBLPROFILER reserves the right to terminate services or access to the website at its sole discretion.

- FTBLPROFILER reserves the right to terminate any phone advisory calls with a user after 15 minutes on the call or at any time if the call is no longer relevant to the individual player's development, opportunities or success.

6.3 **FTBLPROFILER Rights of Refusal**

- FTBLPROFILER has the right to refuse to work with any user upon reimbursing the user for any portion of the services not yet provided by FTBLPROFILER.

**7. Governing Law:**

7.1 **Applicable Law:**

- These Terms and Conditions of Service are governed by the laws of British Columbia.

**8. Changes to Terms and Conditions of Service:**

8.1 **Updates:**

- We may update these Terms and Conditions of Service from time to time. The latest version will be posted on our website with the effective date.
